News: Westchester County Attorney Jeffrey Weiskopf Secures $2,021,000 Jury Verdict in NY Slip-and-Fall Case

A New York jury on December 3, 2025 has returned a $2,021,000 verdict in favor of our client — a 64-year-old man who was seriously injured when he slipped and fell on a wet marble floor in a communal bathroom at The Jane Hotel in New York City.

The verdict for founding attorney Jeffrey Weiskopf has since been nominated for TopVerdict’s Top 100 Verdicts in New York for 2025, and preliminary reports indicate it is expected to be included on the final list.

What Happened

Our client was a guest at The Jane Hotel when he entered the communal bathroom to use the shower. As he stepped onto the marble-tiled floor outside the shower area, he slipped on accumulated water and fell. The impact caused multiple pelvic fractures and spinal disc herniations — injuries that dramatically altered his daily life, his independence, and his relationship with his wife.

Why We Took This Case to Trial

From the beginning, this slip and fall case came down to a simple question: Did The Jane Hotel provide a reasonably safe environment for its paying guests?

Our personal injury attorneys presented evidence at trial demonstrating that the hotel’s marble tile flooring lacked proper drainage and failed to meet accepted standards for slip resistance in wet environments. The hotel knew — or should have known — that water regularly accumulated on these floors and that the surface became dangerously slippery when wet. Despite this, the hotel chose to prioritize the look of its bathrooms over the safety of the people using them.

The defense argued that our client bore responsibility for his own fall. The jury disagreed.

The Verdict

After a multi-day trial, the jury deliberated for just over two hours before returning a verdict in our client’s favor. The jury found The Jane Hotel negligent in failing to maintain a reasonably safe bathroom floor and awarded $2,021,000 in total damages, including compensation for:

  • Pain and suffering
  • Lost earnings
  • Derivative claim on behalf of our client’s wife for the impact on their marriage and daily life

Nominated for TopVerdict’s Top 100 Verdicts in New York (2025)

We are proud to share that this verdict has been nominated for inclusion on TopVerdict’s Top 100 Verdicts in New York for 2025. TopVerdict is a nationally recognized legal publication that tracks and ranks the largest plaintiff jury verdicts across all 50 states, and its annual Top 100 lists serve as a widely respected benchmark for trial results. Based on preliminary data, our verdict is expected to appear on the final list when it is published later this year.

Slip-and-fall cases are among the most heavily contested areas of personal injury law. Defense attorneys and insurance carriers routinely challenge everything from whether the property owner was truly at fault to whether the plaintiff’s injuries are as serious as claimed. Achieving a verdict of this size in a premises liability case reflects not only the strength of the evidence but the commitment to taking the fight all the way to a jury when a fair resolution cannot be reached outside the courtroom.

What This Means for Property Owners and Injury Victims

This case sends a clear message: hotels and property owners cannot prioritize aesthetics over safety and expect to avoid accountability. When a business invites paying guests onto its premises, it has a legal obligation to ensure those premises are reasonably safe — including in communal areas like bathrooms and showers.

Slip-and-fall injuries can happen anywhere — in hotels, retail stores, apartment buildings, restaurants, and parking lots. Whether you were hurt in Manhattan, White Plains, Yonkers, or anywhere else in the New York metro area, the law requires property owners to maintain safe conditions for visitors and guests. When they fail to do so, victims deserve full and fair compensation for the harm they suffer.
